These are the official rules for the 3rd Annual Picture Perfect Pets Contest. All decisions made by Y105 regarding Picture Perfect Pets are final and these rules are subject to change without notice.

2. Term
Entry into the 3rd Annual Picture Perfect Pets (the “Contest”) begins on July 25, 2012 at 8:00 a.m. Central Daylight Time(“CDT”) and ends on August 28, 2012 at 5:00 p.m. CDT (the “entry period”). Judging will take place on or about August 30, 2012. The winner will be announced on August 31, 2012 between 7:00 a.m. CDT and 8:00 a.m. CDT live on Y105.

3. Eligibility
Contest is open to the public. Employees, officers and directors of Sponsors, Y105 and S. Kelly Photography, inc. as well as the members of the immediate families (spouses, parents, siblings and children, and each of their respective spouse, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate. The Contest is subject to all applicable federal, state and local laws and regulations. Entrants are responsible for complying with these Official Rules.

For the pet to be eligible he/she must must be living and currently a part of your family. Entrants may submit three (3) entries per household. Entries should contain a likeness of one pet per photograph. Entries with more than one pet in a photograph will be disqualified.

All photographs submitted to Contest will be assumed to have copyright release. It is not the responsibility of the Contest to secure the rights to display professional copyrighted images.

4. How to Enter
NO PURCHASE NECESSARY, AND A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. To enter visit www.skellyphoto.com and follow the links and instructions to mail, email or set up an appointment to have S. Kelly Photography take your photo.

No photos will be acknowledged. By entering a photo in this Contest, Entrant grants a nonexclusive, transferable, royalty-free, worldwide licence Sponsor to edit, adapt and publish such photo in connection with the Contest and promotion of the Contest for advertising, marketing and promotional purposes in commerce and in any and all media now known or hereafter known throughout the world in perpetuity, without attribution, compensation, permission or further notification to the entrant, his/her successors or assigns, or any other entity, unless prohibited by law. Sponsors do not claim ownership of any copyright in Contest Submissions.

Photograph Requirements

Photographs may not previously have won an award in the Picture Perfect Pets Contests.

The photo must not contain material the violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement.

The photo must not, in the sole discretion of the Sponsors, contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous or libelous

The photo must not, in the sole discretion of the Sponsors, contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex religion, nationality, disability, sexual orientation.

The photo must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where photo is created.

5. Contest Prizes

ONE (1) GRAND PRIZE: A $100 Gift Certificate to S. Kelly Photography, inc., a $50 Gift Card from My Favorite Place Dog Grooming, a Gift Certificate from Pampered Pups and a Gift Certificate from Paw in Hand.

ONE (1) 2ND PLACE RUNNER UP: A $75 Gift Certificate to S. Kelly Photography, inc., a $10 Gift Card from My Favorite Place Dog Grooming, a Gift Certificate from Pampered Pups and a Gift Certificate from Paw in Hand.

ONE (1) 3RD PLACE RUNNER UP: A $50 Gift Certificate to S. Kelly Photography, inc., a $10 Gift Card from My Favorite Place Dog Grooming, a Gift Certificate from Pampered Pups and a Gift Certificate from Paw in Hand.

6. Winner Determination
A non-biased panel of judges determined by Sponsors Y105 in its sole discretion will select the top entrant based on the following criteria: extent to which photo captures the essence of the Contest, creativity, composition and clarity.

7. Winner Requirements
Acceptance of any prize shall constitute and signify winner’s agreement and consent that Sponsors may use the winner’s, name and likeness, Contest entry and/or prize information in connection with the Contest, in commerce and in all media worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.

8. Limitation of Liability
By entering this Contest, all entrants agree to release, discharge, and hold harmless Sponsors, Y105 and S. Kelly Photography, inc., and their respective parent companies, subsidiaries, affiliates, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.

Sponsors assume no responsibility for any of the following in connection with the Contest: any error, omission, deletion, defect or delay in operation or transmission, communications line failure, theft or unauthorized access to Contest entries. Sponsors are further not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, human errors of any kind, fraud by any entrant.

9. Conditions
Entrants and voters agree that this Contest shall be subject to and governed by the laws of the state of Iowa and the forum for any dispute related to the Contest shall be in the jurisdiction of the courts of Dubuque County, State of Iowa.

10. Right to Cancel or Suspend Contest
If for any reason the Contest is not capable of running as planned, due to computer complications, technical failures or any other causes beyond the control of the Sponsors that corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest. In such event, no prizes will be awarded.

11. Winners List
Winners’ names will be available online at www.skellyphoto.com after August 31, 2012 following the verification of all winners.

12. Data Privacy
By entering, entrants agree that personal data, including without limitation name and address, may be processed, shared and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to verify the participants identity, postal address, and telephone number or to otherwise verify the participant’s eligibility to participate in the Contest.

Don’t have a Photo
You can email or call to set up a FREE photo session with S. Kelly Photography at info@skellyphoto.com or (563) 543-0306. Times and dates are limited so please call early to get a day and time that works best for you. (Photo sessions are subject to availability.)

Electronic Photos:
If you have an existing digital photo you can email it to S. Kelly Photography at info@skellyphoto.com. Please include your name, address, phone number and the name of your pet in the photo. (Emailed photos must be received by the entry deadline of August 28, 2012 by 5:00 p.m.)

Physical Photos
You can mail a photo to S. Kelly Photography – Attn: 3rd Annual Picture Perfect Pets – 984 Patricia Ann Drive, Dubuque, Iowa 52003. Please be sure to include your name, address, phone number and the name of your pet in the photo. (Mailed photos must be received by the entry deadline of August 28, 2012.)

If you are dropping off a photo please email S. Kelly Photography at info@skellyphoto.com or call (563) 543-0306 to make an appointment. It is important that you schedule an appointment time to drop off a photo so that we are in the studio when you stop by.

If you would like to have your physical photo returned please include a stamped, self-addressed envelope and we will mail the photo back to you within several days.
